During World War I, in response to substantial advancements in wartime surveillance, it became a common practice to rely on “vision specialists” to devise effective methods of fooling the enemy. These methods, collectively referred to now as camouflage, were designed by so-called camoufleurs, men who in civilian life had been trained as artists, graphic designers, architects, and theatre scenographers. Among the techniques they employed were perspective-based spatial distortions, of the sort that are also frequently used in theatrical set design, trompe (...) l’oeil paintings, and wildlife displays. The use of cost-benefit analysis (CBA) in environmental decision-making and the contingent valuation (CV) technique as input into traditional CBA to elicit environmental values in monetary terms has stimulated an extensive debate. Critics have questioned the appropriateness of both the method and the technique. Some alternative suggestions for the elicitation of environmental values are based on a social process of deliberation. However, just like traditional economic theory, these alternative approaches may be questioned on their implicit value judgements regarding the legitimacy (...) of the social-political organisation of the process of value elicitation. Instead of making assumptions a priori, research efforts should be focused on the processes by which actual public attitudes and preferences towards the environment can best be elicited and fed into environmental or other public policy decision-making. In the study presented in this paper, support was found for both the individual WTP based approach and a participatory social deliberation approach to inform the environmental decision-making process, suggesting that a combination of both approaches is most appropriate. The paper addresses the nature of duties grounded in human rights. Rather than being protections against harm, per se, I contend that human rights largely shield against risk impositions to protected interests. “Risk imposition” is a normative idea requiring explication, but understanding dutiful action in its terms enables human rights to provide prospective policy guidance, hold institutions accountable, operate in non-ideal circumstances, embody impartiality among persons, and define the moral status of agencies in international relations. What does free will mean to laypersons? The present investigation sought to address this question by identifying how laypersons distinguish between free and unfree actions. We elicited autobiographical narratives in which participants described either free or unfree actions, and the narratives were subsequently subjected to impartial analysis. Results indicate that free actions were associated with reaching goals, high levels of conscious thought and deliberation, positive outcomes, and moral behavior (among other things). Demonstrating that a developing norm is not yet well established in international law is frequently thought to show that states are not bound by the norm as law. More precisely, showing that a purported international legal norm has only limited support from well-established international legal sources is normally seen as sufficient to rebut an obligation on the part of subjects to comply with the norm in virtue of its legal status. I contend that this view is mistaken. Nascent norms of (...) international law (e.g., crystallizing norms of customary law) can be binding in much the same way as better-established doctrine. This point becomes perspicuous, I argue, once we get a clear sense of the plausible options for grounding the moral authority of international law generally. -/- This result is interesting in its own right, but it also reveals two other features of the character of state responsibility under international law. First, the distinction between legislation and compliance is less pronounced compared to domestic law. Consequently, the virtues of good governance will frequently be pertinent to determining the content of states’ obligations under international law. Second, normally more powerful and influential agents will be more strongly bound by international law than other subjects. This is an attractive result, addressing a concern that motivates many international lawyers to view international law as absolutely binding. An absolutist view international legal authority is unnecessary for showing that the most powerful and dangerous states are strongly bound by the terms of much existing law. (shrink)

Judicial obligation to enforce the law is typically regarded as both unproblematic and important: unproblematic because there is little reason to doubt that judges have a general, if prima facie, obligation to enforce law, and important because the obligation gives judges significant reason to limit their concern in adjudication to applying the law. I challenge both of these assumptions and argue that norms of political legitimacy, which may be extra-legal, are irretrievably at the basis of responsible judicial reasoning.

Four experiments supported the hypothesis that ordinary people understand free will as meaning unconstrained choice, not having a soul. People consistently rated free will as being high unless reduced by internal constraints (i.e., things that impaired people’s mental abilities to make choices) or external constraints (i.e., situations that hampered people’s abilities to choose and act as they desired). Scientific paradigms that have been argued to disprove free will were seen as reducing, but usually not eliminating free will, and the reductions (...) were because of constrained conscious choice. We replicated findings that a minority of people think lacking a soul reduces free will. These reductions in perceived free will were fully explained by reductions in people’s perceived abilities to make conscious decisions. Thus, some people do think you need a soul to have free will—but it is because they think you need a soul to make conscious decisions. (shrink)

Ronald Dworkin once identified the basic question of jurisprudence as: ‘What, in general, is a good reason for a decision by a court of law?’ I argue that, over the course of his career, Dworkin gave an essentially sound answer to this question. In fact, he gave a correct answer to a broader question: ‘What is a good reason for a legal decision, generally?’ For judges, officials of executive and administrative agencies, lawyers, non-governmental organizations, and ordinary subjects acting in the (...) variety of legal contexts, Dworkin identified the proper basis for a legal decision, and its implications for the form of well-conducted legal reasoning. Dworkin's stance on the above questions can be characterised by two theses. I defend his view by substantiating each. The result is agnostic about the viability of other aspects of Dworkin's legal theory, as it focuses on the grounds of proper legal decision-making. In a morally non-ideal legal system, how can law bind its subjects? How can the fact of a norm’s legality make it the case that practical reason is bound by that norm? Moreover, in such circumstances, what is the extent and character of law’s bindingness? I defend here an answer to these questions. I present a non-ideal theory of legality’s ability to produce binding reasons for action. It is not a descriptive account of law and its claims, it is a (...) normative theory of legal reasoning for particular social circumstances. The approach is, somewhat like Raz’s influential account, instrumental in character. Yet, it denies that the morally binding legal norms are, in whole or part, exclusionary reasons for the responsible subject. Law’s instrumentality must be given an alternative characterization. I here address the question of how judges should decide questions before a court in morally imperfect legal systems. I characterize how moral considerations ought inform judicial reasoning given that the law may demand what it has no right to. Much of the large body of work on legal interpretation, with its focus on legal semantics and epistemology, does not adequately countenance the limited legitimacy of actual legal institutions to serve as a foundation for an ethics of adjudication. I offer (...) an adjudicative theory in the realm of non-ideal theory: I adopt a view of law that has achieved consensus in legal philosophy, make some plausible assumptions about human politics, and then consider directly the question of how judges should reason. Ultimately, I argue that judges should be cognizant of the goods that are at stake on particular occasions of adjudication and that this requires treating legal requirements transparently, i.e., as sensitive to their moral justifications. Technology has expanded genomic research and the complexity of extracted gene-related information. Health-related genomic incidental findings pose new dilemmas for nurse researchers regarding the ethical application of disclosure to participants. Consequently, informed consent specific to incidental findings is recommended. Critical Social Theory is used as a guide in recognition of the changing meaning of informed consent and to serve as a framework to inform nursing of the ethical application of disclosure consent in genomic nursing research practices.

This study provides evidence regarding the level of ethical cognition of business students at the entry to college as compared to a national norm. It also provides comparative evidence on the effects of group versus individual ethical cognition upon completion of a business ethics course. The Principled Score (P-score) from the Defining Issues Test (DIT) was used to measure the ethical cognition of a total sample of 301 business students (273 entering students plus 28 students in a business ethics course). The results indicate that (1) business students are not significantly different from the national norms at entry to college and (2) group reasoning helps male students improve their P-scores significantly in the business ethics course at a loss of P-score (albeit not statistically significant) for female students. The Logic of Port-Royal, first published in 1662 by the Jansenists Antoine Arnauld and Pierre Nicole, is a work that underlines the inadequacies of the traditional logic. Traditional logic, which included the texts of Aristotle's Organon and the works of the scholastics, was experiencing a mild renaissance in the seventeenth century following its outright and brutal discrediting by the humanists of the previous two centuries. Arnauld and Nicole introduce a fairly original system of logic that attempts to remedy the shortcomings (...) of the revived tradition; they dismiss the Aristotelian "Categories", "Predicables", and "Topics", ignore the scholastic "Doctrine of Terms and Consequence", and suggest a single "General Principle" by means of which the validity of all arguments can be decided. The Principle is based on a notion of containment, divided into entendue and comprehension , which applies to all terms. Because the notion of containment is linked to the objective reality of Cartesian ideas, the authors can claim that their system of logic properly describes reality. The General Principle also suggests that terminist logic is logically and epistemologically prior to sentential logic because, Arnauld and Nicole claim, it governs the Dictum de Omni et Nullo and the Nota Notae. The self-evidence of the two dicta confirmed the validity of all syllogisms of the first figure; furthermore, all syllogisms of other figures could be reduced to one of the first figure. With the General Principle, however, there is no need for such reduction to the first figure. This additional result makes the theorem of sentential logic, "$\supset$r)$\approx$$\supset$-q)", which was needed for the reductions of Baroco and Bocardo, unnecessary. The fact that no theorem of sentential logic is needed to underline term logic guarantees the autonomy of the latter. (shrink)
